Working Holiday Maker Visas – third visa amendments

Legislative Instrument –  F2019L00196 – Migration Amendment (Working Holiday Maker) Regulations 2019, increases the maximum number of Subclass 417 and 462 visas a person may hold in Australia to three visas. These Regulations increase the maximum number of ‘working holiday maker’ visas from two to three, where the visa holder meets additional work requirements.  The applicant is required to complete 6 months specified work in specified circumstances in order to be eligible for a third ‘working holiday maker’ visa.  This Instrument amends Schedule I, Items 1224A(3) and 1225(3B) and Schedule 2 subclauses 417.211 and 417.222, and subclauses 462.218 and 462.219, to insert these requirements for an application for a third visa in these subclasses. Applicants for third WHV must have undertaken 6 months specified work while holding a second WHV and that this work was carried out on or after 1 July 2019.  The specified work and circumstances are set out in IMMI 17/018: Working Holiday Visa – Specified Work and Regional Australia) Instrument 2017 This Instrument commences on 1 July 2019.   Source: MIA

The number of places available to Spanish nationals and Israeli nationals for Work and Holiday visa increased

The Work and Holiday visa arrangements with Spain and Israel now allows even more young people to explore, work and study in Australia. The number of places available to Spanish nationals under the Work and Holiday Maker program (subclass 462) will increase from 1,500 per year to 3,400 from 28 December. The number of places available to Israeli nationals will increase from 500 per year to 2,500. Work and Holiday – online lodgement available for more countries

Expansion of the online lodgement channel to additional countries for applicants applying for their first Work and Holiday visa. The existing countries under this arrangement are Spain, Argentina, Uruguay, Slovakia and the United States of America. The new countries under this arrangement are: Austria, Chile, Czech Republic, Hungary, The State of Israel, Luxembourg, Peru, Poland, Portugal, San Marino and Slovenia.  When applying for their first Work and Holiday visa, applicants from these countries must now apply online using Form 1208(Internet) unless the applicant has been sent an email by an officer of the Department authorising the applicant to make an application in a different place or manner as outlined in subsection 6(4) of the Instrument.   The information above is to be taken as general in nature and advice specific to your situation should be done in consultation with a registered migration agent.

Changes of Working Holiday Visa

Legislative Instrument – F2018L01507 – LIN 18/173: Arrangements for Working Holiday Visa Applications Instrument 2018, increases the upper age limit for WHV applicants from Canada and the Republic of Ireland, and the place and manner of making an application for a WHV. This Instrument gives effect to changes in the Schedule 2 Regulations for Subclass 417 WHV made on 1 July 2017, that made provision for age increases to 35 years old. Place and manner of applying – Schedule 1 All Working Holiday Visa 417 applications must be made by using Internet Form 1150 or by requesting authorisation from a Departmental officer to lodge a paper Form 1105, in the following manner: (i)   by attaching a copy of the authorising email to a paper Form 1150, and (ii)  by the end of the next day after which the authorising email was sent (AEST or AEDST as applicable to the date on which the authorising email was sent)—submitting the application in accordance with the directions in the authorising email. Countries, conditions and age requirements – Schedule 2 For Canada and the Republic of Ireland, Items 2 and 10, of this schedule now indicate that there is no maximum age specified for applicants holding these passports.  However, it is noted in this schedule that for Schedule 2, Reg 417.211(2)(b) that the maximum age must be no more than 35 years old. The Tourist stream and Sponsored Family Stream visitor visa applications lodgement address will change from 01/07/2018.   Addresses for lodging Tourist stream visitor visa applications Previously these applications were posted  or delivered by courier to the Department’s office in Adelaide, but will now be required to be posted to or delivered by courier to the Sydney office. China A fourth Australian Visa Application Centre has been added to the addresses where applications for Subclass 462 Work and Holiday visas can be lodged in China: Chengdu, Room 2-2, 2/F, No 11-15, Section 4, South Renmin Road, Wuhou District, Chengdu City, Sichuan Province CHINA 610041 Peru Peru has been specified as a country where eligible passport holders may apply for a Subclass 462 Work and Holiday visa. Schedule 2 of this Instrument provides that applicants are required to hold tertiary qualifications or to have successfully completed at least two years of undergraduate university study to be eligible to apply for this visa. The postal and street addresses for lodging applications for this visa in Santiago De Chile are also listed in Schedule 2. The upper age limit for applicants from Peru making a Subclass 462 (Work and Holiday) visa application is 30 years old.

186/187 Visa Changes Summary

Recent changes to the 186 and 187 visa have been confusing and alarming to say the least. It not only caught the general public by surprise but even professional in this industry were not aware of these changes. Therefore, we have released a guide to help simplify and provide an overview of the most recent changes. Here is a chronology of the changes yet to come: From 1 July 2017 Occupation lists will be further reviewed. IELTS score of 6 in each component required (or equivalent test). Currently the 186 and 187 visa have two streams Direct Entry (DE) and Temporary Resident Transition (TRT). The maximum age for DE is 45, whereas a maximum age of 50 still applies to TRT applicants. Before 31 December 2017 Immigration will collect Tax File Numbers of visa holders for data matching. Immigration will publish details of sanctioned sponsors. From March 2018 MLTSSL occupation list will now apply, with additional occupations available to support regional employers for the RSMS. Employers must pay the Australian market salary rate and meet minimum wage threshold of $53,900. Permanent Residency eligibility period will be extended from two years to three years. ALL applicants must be under the maximum age of 45 at the time of application.
