The rules for the new Subclass 870 (Sponsored Parent (Temporary)) visa

The new Migration Amendment (Temporary Sponsored Parent Visa and Other Measures) Regulations 2019 will commence on 17 April 2019, and it includes the details of the Temporary Sponsored Parent Visa (TSPV), which provides parents with a new pathway to temporarily reunite with their children and grandchildren in Australia. To be eligible for the visa, a parent must be the biological, adoptive, or step-parent of the sponsor, who must be an Australian citizen, Australian permanent resident, or eligible New Zealand citizen. The sponsor also must have a minimum household taxable income threshold of $83,454.80 and  have no debts to the Commonwealth or outstanding public health debts. Five Year Parent Visa – from 17 April 2019

Minister Coleman has announced today that the new five year sponsored parent visa, the Subclass 870 Parent (Temporary) Visa, will be open for application on 17 April 2019. Parents will be able to stay for up to five years at a time without departing and the Department has announced that up to 15,000 per year will be granted. NB: The introduction of this visa is still subject to introduction of supporting regulations Charges Sponsorship application: $420 Visa application charge: $5,000 for 3 years duration, $10,000 for five years duration   The visa application charge is payable in two instalments, with one payment at time of application and the remainder paid prior to visa grant.   Other features include: No Balance of Family test will be applied ‘No work’ conditions will be applied Require health insurance Must provide evidence of access to funds   Further information is available on the  Department’s website  Source: MIA

For those lodging a parent visa or any other visa requiring the lodgement of a bond, the Assurance of Support (AoS) is quite common. It usually starts at just over $5,000 but most will agree that its is on average $10,000. For parent visas, the $10,000 bond could be locked away for 10 years before it can be refunded. However, there is an EXCEPTION! For cases finalised before 1 July 2004, only Centrelink has the authority to release an AoS bond where the visa has been cancelled and the visa holder has not arrived in Australia. Centrelink cannot release a bond in situations where a person changes from one visa type to another (unless the new visa is a humanitarian visa) or ceases to hold the visa due to obtaining Australian citizenship, as these do not affect the continuation of the AoS period. 5-years continuous stay visa for parents

The Coalition has promised a continuous five-year visa for parents of Australian residents, currently offered to only to those applicants on a case-to-case basis who have lodged a concurrent permanent parental visa application. If re-elected, the Coalition will remove the requirement for these parents to have lodged a concurrent permanent parental visa application. “The Coalition recognises that many Australians, including our growing South Asian and Chinese communities, face particular pressures through the separation of children from parents and grandchildren from grandparents,” Peter Dutton said. “We want to help families reunite and spend time together, while ensuring that we do so in a way that does not burden Australia’s health care system,” he added. In  order to apply for the enhanced parental visitor visa, the applicants will have to buy private health insurance from an Australian insurance provider, and they or their sponsoring family will be required to pay a bond. Unveiling its ‘Long Stay Parental Visa’ policy, the Labor last week promised a parental visa that would allow parents of migrants a continuous stay of three years. Labor’s proposal also has the conditions a mandatory private Australian insurance policy and a $5000 bond for each applicant. Currently, visiting parents of Australian citizens and permanent residents are allowed a continuous stay of up to 12 months. Some members of the migrant communities had to launch a campaign in order to get political attention to their longstanding demand of a long-stay-parental-visa. Originally published on SBS.
